Welcome to the app. These Terms and Conditions ("Terms") constitute a legally binding agreement between you ("User", "you", or "your") and the provider of this app ("Company", "we", "us", or "our"), governing your access to and use of the mobile application and any associated services.

By accessing, downloading, or using the app, you agree to be bound by these Terms and our Privacy Policy. If you do not agree with any provision, you must refrain from using the service.

Important Notice: the app is not a gambling platform. Participation in events, even those that may involve entry fees or lead to rewards, is based solely on user skill, creativity, and public rating. The app operates as a talent-based video competition platform where users are rewarded by community recognition, not chance. This distinction is fundamental to the nature of our service.

1. Acceptance of Terms

By registering for, accessing, or using the app, you confirm that you have read, understood, and agreed to these Terms and Conditions and our Privacy Policy. If you are under the age of 18, you confirm that you have obtained consent from a parent or legal guardian.

2. Eligibility

Legal Disclaimer: the app strictly complies with international laws concerning child protection and digital safety, including GDPR, COPPA, and equivalent regional frameworks. This platform is not a form of gambling, sweepstakes, or lottery. All participation is based on user skill, creative ability, and public feedback (e.g., ratings). Rewards are never based on chance. The purchase or use of ClipChips does not increase the likelihood of winning or gaining visibility. The app is a skill-based video competition platform and does not incorporate chance-based outcomes or randomized prize mechanics of any kind.

Use of our service is permitted only to individuals who are at least 18 years old. If you are under the age of 18, you may only access the platform with verified parental or guardian consent.

Participation in any event that includes monetary prizes or financial transactions may be restricted to users aged below 18 depending on applicable legal regulations in your jurisdiction.

3. Account Registration and Responsibilities

Users must provide accurate, current, and complete information during account creation. You are responsible for maintaining the confidentiality of your login credentials and for all activities that occur under your account.

We reserve the right to suspend or terminate accounts that are suspected of being fraudulent, abusive, or in violation of these Terms.

4. User-Generated Content

You retain ownership of any content you submit or upload, including videos and profile information. However, by submitting content, you grant us a non-exclusive, royalty-free, worldwide license to use, host (via Cloudflare Stream), display, and distribute such content for the purposes of operating, marketing, and improving the platform.

Content must not:

• Violate any law or regulation

• Be defamatory, obscene, harassing, or otherwise inappropriate

• Infringe upon any third-party rights

We reserve the right to remove content or restrict user access at our discretion.

5. Intellectual Property

All content, designs, logos, and brand names on the platform, including the name "ClipKing", are the exclusive property of the ClipKing brand and are protected by copyright laws. 

The ClipKing name and logo are currently used as unregistered trademarks (™). Unauthorized use, reproduction, or distribution of any part of this platform, including but not limited to its name, logo, visual elements, and underlying code, is strictly prohibited without prior written permission.

We reserve all rights to take legal action against infringement or misuse of our intellectual property.

6. Payments and ClipChips

Some features of the app may require payment. Transactions are processed securely via third-party app store payment providers such as Google Play Billing and Apple In-App Purchase.

We do not store or directly handle your payment information. All payment processing is subject to the terms and privacy policies of the respective app store providers:

We offer an in-app currency known as ClipChips, which can be purchased using real money exclusively through Google Play or Apple In-App Purchase systems. ClipChips can be used within the app to unlock features such as submitting videos to events.

ClipChips:

- Have no monetary value outside the app

- Are non-refundable once purchased

- Cannot be exchanged for real money or transferred between users

- If you delete one of your videos, half of the ClipChips will be given back to you

- Are subject to change in pricing, availability, or usage terms at the discretion of the Company

Refund Policy: Payments and ClipChips are non-refundable unless explicitly required by applicable law or the respective app store refund policies.

7. Limitation of Liability

The app is provided "as is" and "as available" without warranties of any kind, either express or implied. We do not guarantee that the service will be uninterrupted, secure, or error-free.

To the maximum extent permitted by law, we shall not be liable for any indirect, incidental, or consequential damages arising out of or relating to your use of the service.

8. Account Termination

We reserve the right to suspend or terminate your access to the platform, without notice, for any violation of these Terms or other misconduct, including illegal behaviour or abuse of the service.

9. Amendments

We may revise these Terms periodically. When changes occur, we will provide notice via the app or registered email. Your continued use of the service after such updates constitutes your acceptance of the revised Terms.

10. Governing Law

These Terms shall be governed and construed in accordance with the laws of Hungary, excluding its conflict of law provisions.
